Judge Juan Varillas suspended in Peru over Naviera Curaray case
The National Control Authority of the Judiciary (ANC-PJ) has imposed a six-month preventive suspension on Judge Juan Gustavo Varillas Solano, head of Lima’s Seventh Civil Court with a commercial sub-specialty. This is the judge's fourth suspension and his second this year.
The current disciplinary procedure investigates alleged irregularities regarding a lawsuit filed by Carlos Ríos Padilla against Naviera Curaray S.A.C. concerning the nullity of corporate agreements. The ANC-PJ alleges that Varillas violated duties of impartiality and due process by appointing the plaintiff himself as the provisional judicial administrator of the company, despite the plaintiff having a conflicting economic interest.
Additional investigations have been opened regarding the alleged failure to require the reimbursement of judicial fees and the improper classification of a subordinate claim as a primary one. This follows a previous suspension in August related to a precautionary measure that halted share transfers within Grupo El Comercio.
