Lisbon Court rejects injunction against Oeiras tree planting
The Lisbon Court of Appeal has rejected an injunction filed by residents of the Skycity Urbanization in Amadora against the Oeiras Municipality. The legal dispute concerns the planting of approximately 130 trees along the municipal border, which residents described as a vegetal ‘wall’.
Plaintiffs argued that the tree line would obstruct views of the Serra de Carnaxide and cause issues regarding shading, allergies, and fire risks. However, the court ruled that planting trees up to the boundary line of neighboring properties is permitted under Portuguese law. The court further determined that the loss of views is a natural consequence of the lawful exercise of the right to fencing and does not constitute a violation of property rights.
The Oeiras Municipality expressed satisfaction with the decision, which confirms the legality of the intervention. The project had previously sparked controversy following comments by Mayor Isaltino Morais regarding construction encroachment from neighboring Amadora.
