Litigation financing is viewed as a growing frontier in the Brazilian legal market, offering new models for negotiation and investment. While established in countries such as the United States, the United Kingdom, and Australia, the practice remains a subject of debate in Brazil regarding regulation and its impact on procedural balance. Proponents suggest the mechanism can expand access to justice by allowing parties to pursue complex resolutions, such as arbitration, without being limited by high costs. This can prevent economically stronger parties from using financial pressure as a tactic and encourages more strategic dispute resolutions within a multi-door justice system.
