Local governments debate data center development moratoriums

Local governments in the United States are navigating regulatory challenges regarding the rapid expansion of data centers. In Guilford County, the Board of Commissioners recently postponed a decision on a proposed six-month moratorium for data center development, cryptocurrency mining, and related processing facilities. During public hearings, some residents argued that a 180-day pause is insufficient to study the impacts on water supplies, electricity infrastructure, and the environment, with some calling for a 32-month moratorium instead.

In Hubbard Township, trustees have scheduled a public meeting for October 28 to discuss new zoning language proposed by the township’s zoning commission. This follows a one-year moratorium implemented in February. The proposed regulations would classify data centers and high-energy facilities as conditional uses, requiring proof that they will not negatively impact noise, traffic, water demand, or utility infrastructure. The proposal also includes specific setback requirements from residential areas, schools, and community centers, alongside a minimum 100-acre requirement for any data center campus.
