Louisiana Enacts Stricter Penalties for Repeat DWI Offenders Effective August 2026

Louisiana lawmakers approved House Bill 82, a new law that raises fines and prison terms for drivers convicted of multiple DWI offenses. The legislation takes effect on August 1, 2026. Under the bill, a second DWI carries a $2,000 fine and at least two years in prison, while a fourth DWI can result in up to 12 years behind bars and fines up to $5,000.

The move follows state data showing that alcohol‑related crashes made up more than 30% of all crashes in 2023, with 261 alcohol‑impaired driving fatalities recorded in 2022 and over 13,600 DWI arrests nationwide in 2024. Lawmakers said the tougher penalties are intended to curb repeat offenses and improve road safety for Louisiana drivers and passengers.
