Indonesia debates corruption law reform over state loss definition
The National Economic Council (DEN) has proposed revising Indonesia's Anti-Corruption Law (UU Tipikor) to align with the United Nations Convention Against Corruption (UNCAC). The proposal, led by DEN Chairman Luhut Binsar Pandjaitan, suggests shifting the focus from state financial losses toward bribery to prevent business leaders and state-owned enterprise (BUMN) officials from fearing criminal charges due to legitimate commercial risks.
President Prabowo Subianto has reportedly agreed to the DEN's study regarding this definition change. Coordinating Minister for Law, Human Rights, Immigration, and Correctional Affairs Yusril Ihza Mahendra supports the reform, noting that the current definition may cause officials to avoid making necessary business decisions for fear of being accused of corruption if a venture results in a loss.
However, the Corruption Eradication Commission (KPK) opposes the total removal of the state loss element. KPK Chairman Setyo Budiyanto stated that while the agency does not support eliminating the element entirely, it could potentially be reformulated as an aggravating factor in corruption sentencing. The KPK also identified four urgent areas for regulation under UNCAC standards: foreign bribery, trading in influence, private sector bribery, and illicit enrichment.
