Luis Caputo's dismissal faces review by Argentina's Cassation Court

The Federal Chamber of Criminal and Correctional Appeals in Argentina has ruled that the dismissal of Economy Minister Luis Caputo is subject to review by the Federal Chamber of Criminal Cassation. This decision follows an appeal by prosecutor Eugenia Anzorreguy de Silva regarding Caputo’s previous dismissal in a case involving the issuance of a 100-year bond during the administration of Mauricio Macri.

The investigation centered on allegations that Caputo failed to declare links to companies that benefited from the bond issuance while he served in the Ministry of Finance. Specifically, the case examined potential omissions in his sworn financial statements between 2014 and 2016, as well as possible ties to the financial group Noctua and the use of privileged information.

The appellate court's decision was split. Judges Pablo Bertuzzi and Pablo Yadarola voted to admit the appeal, noting that the dismissal constituted a “definitive sentence” that irrevocably closed the process, thereby meeting the legal requirements for a Cassation review. Conversely, Judge Mariano Llorens dissented, arguing that the prosecutor’s arguments merely re-edited previously rejected reasons and were insufficient to warrant intervention from the higher court.
