Luis Manuel Aviles Roa released from immigration detention

Luis Manuel Aviles Roa, a 48-year-old Nicaraguan national, has been released from federal immigration custody following his arrest in Key West, Florida. His detention sparked significant public backlash due to his status as the father of Joshua Aviles, a U.S. Navy sailor currently deployed in the Middle East aboard the USS Abraham Lincoln.

Aviles Roa had lived in the United States for 19 years and reportedly held a work permit, a driver's license, and a Social Security number while awaiting a green card. The Department of Homeland Security (DHS) stated that his detention was based on an undocumented entry into the country, noting that having a family member in the military does not grant automatic legal status or immunity.

According to Department of Justice records, an immigration judge dismissed the case against Aviles Roa on Monday, only hours after he was processed at a detention facility in Miami. Legal experts described the rapid sequence of charges and subsequent dismissal as “super unusual.” The incident occurs amid heightened scrutiny of immigration enforcement practices involving the families of active-duty service members.
