Maciej Berek's Constitutional Tribunal candidacy faces public opposition

A recent IBRiS poll conducted for ‘Rzeczpospolita’ indicates that approximately 60 percent of Poles oppose the candidacy of Maciej Berek, a former minister, for a judgeship on the Constitutional Tribunal. Respondents expressed concern that his appointment would violate judicial independence and lead to further politicization of the court.

Opposition to the nomination is widespread across the political spectrum. While 82 percent of opposition voters oppose the move, significant portions of the ruling coalition's electorate also hold critical views. Specifically, 43 percent of ruling coalition supporters are against the candidacy, and only 37 percent support it.

Legal experts and social organizations have voiced strong opposition. Nine foundations, including the Helsinki Foundation for Human Rights, have appealed to Berek to withdraw his candidacy. Magdalena Biejat, Vice-Marshal of the Senate, suggested that the coalition should choose a ‘less politically profitable’ path by nominating individuals from outside of active politics to restore public trust in the Tribunal.
