Maciej Berek to run for Constitutional Tribunal judge

Prime Minister Donald Tusk has confirmed that Maciej Berek, the current minister for overseeing government policy implementation, will resign from his government position to run for a judgeship at the Constitutional Tribunal. Tusk defended the move, describing Berek as a highly competent, non-partisan legal expert and a “statesman through and through” who is uniquely prepared to help repair the flawed tribunal.

The announcement has sparked significant debate within the ruling coalition and among opposition parties. While some coalition members, such as Władysław Kosiniak-Kamysz, support the need for judicial reform, others have expressed concerns. Specifically, the Lewica party has indicated it may not support Berek's candidacy in the Sejm. Critics, including PiS MP Jacek Sasin, have accused the government of hypocrisy, noting that the coalition previously campaigned heavily against the politicization of the Constitutional Tribunal.

In response to Berek's departure, Joanna Knapińska, head of the Government Legislation Centre, will take over his ministerial duties. Regarding the potential appointment, the Presidential Palace noted that if the Sejm votes to elect Berek, President Karol Nawrocki would accept his oath provided all legal procedures are strictly followed.
