Maciej Berek demands Constitutional Tribunal oath from President Nawrocki

Maciej Berek, elected by the Sejm to the Constitutional Tribunal on September 4, 2026, has formally requested President Karol Nawrocki to designate a time and place for his oath of office. Berek, a former minister in Donald Tusk's government, emphasized that taking the oath is a legal obligation and warned that failing to do so could be interpreted as a resignation from the position.

The dispute centers on whether Berek meets the formal requirement of ten years of legal practice. The Presidential Chancellery has expressed doubts regarding his professional seniority and stated that the President will only administer the oath once documents confirming his legal career are provided.

Berek has stated he will not remain in a state of legal limbo and has prepared alternative steps to ensure his oath is administered and delivered to the President, regardless of the traditional ceremony format. Meanwhile, the Head of the Sejm Chancellery, Marek Siwiec, noted that no preparations are being made for an oath ceremony in the Column Hall.
