Madagascar High Constitutional Court rejects Kintana's request to dissolve National Assembly

The High Constitutional Court (HCC) of Madagascar has rejected a request from the Kintana political party to dissolve the National Assembly. The party, represented by Secretary General Marcel Ralainirina, had filed the request citing an “institutional deadlock” between the Executive and the National Assembly.

The HCC ruled the request inadmissible, noting that under Article 118 of the Constitution, political parties do not have the legal standing to directly petition the Court for such a procedure. Furthermore, the Court clarified that the power to dissolve the Assembly belongs to the President of the Republic, following consultation with the Prime Minister and the presidents of the Assemblies, rather than the judiciary.

The Court also noted that the party incorrectly cited Article 68 instead of Article 60 regarding dissolution powers. Additionally, the ruling referenced constitutional restrictions that prevent the application of certain provisions, including Article 60, during specific periods of presidential vacancy.
