Maddaloni man convicted for violating urban ban near clinic

The Italian Court of Cassation has upheld the conviction of Massimo Di Tommaso, a 46-year-old man from Maddaloni, for violating an urban ban (Daspo) issued by the Questore of Caserta.

Di Tommaso had been prohibited from accessing the area in front of the San Michele clinic due to repeated illegal parking activities. Judges determined that his conduct involved obstructing and limiting public access to the clinic's parking areas to manage them for his own benefit, which posed potential security risks given the high volume of people at the facility.

The defense had appealed the decision, arguing that the ban lacked concrete evidence of a threat to public security. However, the Third Criminal Section of the Court of Cassation rejected the appeal, confirming the previous rulings from the Tribunal of Santa Maria Capua Vetere and the Court of Appeal of Naples.
