Madhya Pradesh High Court denies grace marks to MBBS student

The Madhya Pradesh High Court has denied a request for grace marks to an MBBS first-year student who failed the anatomy subject by a single mark. The petitioner, Ram Naresh Kushwaha, a student at Gajra Raja Medical College in Gwalior, sought a re-evaluation and the provision of one additional mark to save his academic year.

A division bench comprising Justice Anand Pathak and Justice B.P. Sharma dismissed the petition against Madhya Pradesh Medical University, Jabalpur. The court ruled that there is no provision within the National Medical Commission (NMC) regulations to grant grace marks.

The court emphasized that it cannot direct a university to act against established regulations, noting that the absence of a formal provision for grace marks means relief cannot be granted solely on the basis of a student being close to passing or to prevent the loss of an academic year. The court also stated that the personal opinion of a professor from another medical college was insufficient grounds to override official examination rules.
