Madras High Court upholds Rs 2.5 lakh monthly maintenance order

The Madras High Court has upheld a family court order awarding Rs 2.5 lakh in monthly maintenance to a woman and her child. The court noted the husband's monthly income was Rs 10 lakh and that the woman had no regular source of income following the birth of their son.

The case involved allegations that the man had suppressed an existing marriage when the couple married in 2020. While the man denied the existence of the marriage or a shared residence, the family court ruled that he could not take advantage of his own wrong. The High Court observed that strict proof of marriage is not essential for maintenance claims under Section 125 of the CrPC if a continuous relationship is established.
