Madrid Assembly passes law to count unborn child as family member for aid eligibility

The Assembly of Madrid approved a new regional law that recognises the unborn child as a member of the family unit for the purpose of accessing public assistance. The measure passed in an extraordinary session with votes from the centre‑right People’s Party (PP) and Vox, while the PSOE and Más Madrid opposed it.

The law allows families to include the conceived but not yet born child when calculating income‑based benefits, such as high‑school scholarships, early‑childhood education subsidies, school‑meal vouchers, transport passes, youth rent aid and certain tax deductions. Status as a large family is granted from the day after the 14th week of gestation. The regulation will be published in the official bulletin and come into force six months later, as part of Madrid’s 2022‑26 strategy on maternity, paternity and natality.

The text also authorises the regional government to issue implementing decrees and provides alternative administrative routes for applicants unable to use online platforms.
