Madrid court permits coliving in multi-unit buildings

The Audiencia Provincial de Madrid has ruled that coliving arrangements in multi-unit buildings are legally permissible and must be distinguished from short-term tourist rentals.

According to the court's decision, coliving models are considered regular housing rather than tourist accommodation provided two specific criteria are met: the contractual minimum rental period for each room must be at least one month, and residents must be properly registered with local authorities during their stay.

The ruling clarifies that existing municipal bans on holiday rentals do not automatically apply to coliving services. Furthermore, for a homeowners' association to prohibit such arrangements, a unanimous amendment to the community statutes would be required.
