Madrid passes 'conceived unborn' law recognizing fetus as person

The Community of Madrid approved a law that classifies the unborn child as a “member of the family” and grants it full legal personhood from the moment of conception. The text frames the measure as an administrative aid for pregnant women, but critics argue it is a strategic step toward restricting abortion rights, echoing language from the regional president Isabel Díaz Ayuso’s statements that the unborn has rights from the first minute.

Alberto Núñez Feijóo, leader of the People’s Party, said he would introduce an identical law nationwide if his party wins the next election, while Vox’s leader Santiago Abascal has pledged to repeal the national abortion law. The proposal has sparked debate over its legal implications for ectopic pregnancies, early fetal loss, assisted‑reproduction treatments and frozen embryos, raising concerns about how such a definition could affect women’s health and existing civil codes.
