Magdalena prison abuse case: Defense appeals detention of nurse

The defense for Raquel Noemí Boccardo, a nurse for the Buenos Aires Provincial Penitentiary Service, has appealed her preventive detention. Boccardo is implicated in a case involving alleged torture and sexual abuse at Penal Unit No. 51 in Magdalena.

Defense attorney Cristian González filed the appeal with the La Plata Court of Guarantees, seeking the annulment of the charges and Boccardo's immediate release. The defense argues that the prosecution has not specified Boccardo's concrete actions that would make her a necessary participant in the alleged torture. Furthermore, the defense claims the judge improperly incorporated new behaviors into the resolution that were not previously formulated by the prosecution.

While the appeal is pending, the defense has requested house arrest with electronic monitoring. The defense of ten other penitentiary staff members, who were also placed under preventive detention, has also been filed for review by the La Plata Court of Appeals and Guarantees.
