Magosi seeks to overturn backpay judgment for public officers
Peter Magosi, Director General of the Directorate of Intelligence and Security (DIS), has filed an application in the High Court to overturn or amend a 2024 default judgment regarding salary progression back-pay for 407 public officers.
The government, alongside the Directorate of Public Service Management and the Attorney General, argues the original ruling is too vague to implement. Magosi contends the judgment is "ambiguous, obscure and incapable of implementation" because it fails to specify exact amounts owed, which employees qualify, or whether back pay should be calculated from 2001 or 2008.
Magosi further argues that salary progression is not an automatic entitlement but is dependent on employee performance and qualifications. The applicants are seeking to have the matter reopened for a full trial to provide legal certainty.
