Maharashtra FDA conducts major food safety crackdown and legal challenge

The Maharashtra Food and Drug Administration (FDA) has launched an extensive enforcement drive ahead of the festive season, seizing adulterated and substandard food products worth approximately Rs 12.74 crore. The crackdown, spanning seven divisions including Mumbai, Pune, and Nagpur, resulted in the cancellation of 68 licenses and the seizure of massive quantities of stock, such as 197,480 kg of items in the Chhatrapati Sambhajinagar division. Investigations also uncovered a supply chain where expired or spoiled food intended for destruction was being reintroduced into the market.

Parallel to these enforcement actions, the Maharashtra government has filed a petition in the Bombay High Court against the Food Safety and Standards Authority of India (FSSAI). The state alleges that the central regulator has unconstitutionally established a parallel enforcement regime, thereby usurping the statutory licensing and inspection powers of state authorities. The petition specifically challenges the FSSAI’s ability to restrict state officers from inspecting centrally licensed establishments and its recent changes to turnover thresholds for licensing.
