Maharashtra real estate MahaRERA refund Supreme Court housing order developer obligations clubhouse construction

The Maharashtra Real Estate Regulatory Authority (MahaRERA) ordered a Mumbai developer to refund a homebuyer ₹5 lakh collected as clubhouse membership fees because the promised clubhouse has not been constructed even after more than six years since possession was given.

Separately, the Supreme Court ruled that the Maharashtra Housing and Area Development Authority (MHADA) can enforce a developer’s obligation to provide permanent alternate accommodation to occupants of a redeveloped building. The court directed the developer to execute a Permanent Alternate Accommodation Agreement and hand over possession of three flats to the legal heirs within two months, overturning a lower‑court decision that had limited MHADA’s enforcement powers.
