Mahmoud Khalil petitions U.S. Supreme Court over immigration detention

Mahmoud Khalil, a pro-Palestinian activist and Algerian citizen holding U.S. permanent residency, has petitioned the U.S. Supreme Court to review a ruling regarding his immigration detention and potential deportation. Khalil is challenging a decision by the 3rd U.S. Circuit Court of Appeals, which held that federal district courts lack jurisdiction to review the legality of immigration detentions until immigration courts have fully considered the case.

Khalil, a former Columbia University graduate student, was arrested by federal agents in March 2025 following his involvement in anti-Israel demonstrations. Secretary of State Marco Rubio invoked federal immigration law to seek his removal, arguing that Khalil’s activities undermined U.S. foreign policy interests. The government also alleges that Khalil failed to accurately report background information on his residency application, specifically regarding his work with the UN Relief and Works Agency (UNRWA).

Khalil’s legal team argues that the current ruling allows the government to detain individuals for extended periods without immediate judicial oversight, potentially chilling protected speech. While a federal judge in New Jersey previously ordered Khalil’s release after finding the government's actions unconstitutional, the Department of Homeland Security maintains that the administration acted within its statutory and constitutional authority.
