TMC rebel MPs receive Lok Sabha notices over disqualification pleas
The Lok Sabha Secretariat has issued formal notices to 20 rebel Trinamool Congress (TMC) Members of Parliament, demanding responses within seven days regarding disqualification petitions filed under the anti-defection law. The notices, issued under Rule 6 of the Members of Lok Sabha (Disqualification on Ground of Defection) Rules, 1985, follow a petition by TMC leader Abhishek Banerjee challenging the delay in deciding these cases.
The dispute centers on 20 MPs who reportedly joined or merged with the Tripura-based Nationalist Citizens Party of India (NCPI) and aligned with the NDA. While the rebel group maintains their move is a valid merger, the TMC argues the shift constitutes voluntarily giving up party membership, which triggers disqualification under the Tenth Schedule of the Constitution.
The Supreme Court of India has also intervened, issuing notices to the 20 MPs following Banerjee’s plea for an expedited decision. During proceedings, the court emphasized the need to conclude the proceedings within a defined timeframe rather than just issuing notices. Solicitor General Tushar Mehta, representing the Lok Sabha Speaker and the Secretary-General, informed the court that the Speaker had already initiated the notice process.
