Malawi Government denies role in court challenge against Parliament

The Malawi Government has issued a formal denial regarding its involvement in a High Court case challenging planned parliamentary investigations into several state institutions. Minister of Information and Communications Technology Shadrick Namalomba stated that the legal action was initiated independently by a private citizen, Austin Mkoka, acting in his personal capacity.

In an official statement, the government emphasized that it did not initiate, direct, sponsor, facilitate, or fund the proceedings. This clarification follows concerns that the legal challenge, which involves Speaker of the National Assembly Sameer Suleman, could be perceived as an attempt by the Executive branch to interfere with the legislature or undermine the authority of the Speaker.

The dispute centers on Mkoka’s argument that Parliament’s proposed investigations may exceed the constitutional powers and mandate granted to the legislature. The High Court is expected to examine whether these oversight activities fall within constitutional limits, a case that has intensified public debate regarding the separation of powers between Malawi’s Executive, Legislature, and Judiciary.
