Malaysia implements Cross-Border Insolvency Act 2026
Malaysia has implemented the Cross-Border Insolvency Act 2026 (Act 877), which officially came into force on August 28. The legislation provides a specific mechanism to manage insolvency proceedings involving debtors, assets, or creditors across multiple jurisdictions.
Ministers Datuk Seri Azalina Othman Said and Datuk Armizan Mohd Ali stated that the act is part of the MADANI Government's legal reform agenda to ensure the national legal framework remains relevant to international trade and economic developments. The act is based on the UNCITRAL Model Law on Cross-Border Insolvency but has been adapted to suit Malaysian laws, judicial practices, and public interest.
The implementation aims to increase the efficiency of cross-border insolvency case management, strengthen cooperation between courts and relevant authorities, and provide legal certainty. Additionally, the act is intended to maximize debtor asset value, facilitate business rescues, protect investments, and preserve jobs.
