Mandatory industry pension funds create challenges for Dutch companies

Under the Mandatory Participation in an Industry Pension Fund Act 2000, approximately 80% of Dutch companies are required to participate in industry-specific pension funds (Bpf). This legal framework removes the freedom of choice for both employers and employees within designated sectors.

Disputes frequently arise regarding the 'scope of application,' which defines which companies must join a specific fund. Determining this scope is often complex because it is based on the actual activities of a company rather than its official statutes, website descriptions, or Chamber of Commerce codes. Different funds use different criteria to determine eligibility, such as turnover, labor costs, or specific job functions.

Complexity increases for modern businesses that combine multiple activities. For example, a company acting as both a wholesaler and a service provider may face uncertainty regarding which pension fund applies. In many instances, funds utilize the 'principality criterion' to decide based on the company's primary activity.
