Mansuè driver convicted of drunk driving while on foot

A driver in Mansuè, in the province of Treviso, has had his conviction for driving under the influence upheld despite being on foot at the time of the police check. The individual, a resident of Motta di Livenza, was found near an ATM after his vehicle had been parked for more than fifteen minutes.

The court confirmed a sentence of three months of arrest and a six-month suspension of his driver's license. Although the defense argued that there was no certain way to link the detected blood alcohol level to the actual moment of driving, the judge rejected the appeal.

The ruling is based on Article 186 of the Italian Highway Code, which establishes that a person does not need to be physically behind the wheel at the moment of testing to be held liable. Under established jurisprudence, driving under the influence can be proven through circumstantial evidence, including the position of the vehicle, witness testimony, and the close temporal proximity between the time the car was parked and the alcohol test.
