Maranhão Court suspends São Luís Municipal Guard career changes

The Court of Justice of Maranhão (TJMA) has suspended the effects of Municipal Law No. 8.129/2026, which established new rules for the remuneration, career plans, and disciplinary regimes of the São Luís Municipal Guard.

In a monocratic decision, Justice Jamil de Miranda Gedeon Neto granted an injunction following a Direct Action of Unconstitutionality filed by Mayor Esmênia Miranda. The City Hall argues that the Municipal Chamber exceeded its legislative competence by introducing amendments to an executive-initiated project. These changes included reducing the weekly work hours from 40 to 30, modifying the subsidy table, and creating new shift regimes.

The Mayor's administration contends that these legislative amendments significantly increased the projected financial impact for 2026, raising costs from R$ 3.75 million to R$ 12.43 million. The court noted that while legislators may propose amendments, they cannot create new expenses in matters reserved for executive initiative, such as public servant remuneration and legal regimes. The suspension remains in effect pending a final ruling by the court's Special Body.
