Maranhão Public Ministry orders school physical‑education overhaul and sues Smart Fit over contract clauses

A court ordered the municipality of Nova Iorque in Maranhão to regularize physical‑education classes in its municipal schools. The ruling requires the city to submit a detailed list of all PE teachers, an inventory of sports equipment, and a 60‑day plan to correct staffing and infrastructure deficiencies. Non‑compliance will incur a daily fine of R$ 1,000, capped at R$ 50,000, payable by Mayor Daniel Castro.

The Maranhão Public Ministry also filed a civil public action against Smart Fit Escola de Ginástica e Dança S.A., alleging abusive contract terms such as a 20% early‑termination penalty, automatic renewals, and mandatory data collection. The ministry seeks an immediate suspension of the clauses, a daily fine of R$ 15,000 for violations, and collective moral damages of R$ 500,000, with the aim of protecting consumers nationwide.
