Marc Aaron Potash indicted in alleged $100M COVID-19 test fraud scheme
Marc Aaron Potash, 57, of Rockville, Maryland, has been indicted by a federal grand jury for his alleged role in a COVID-19 healthcare fraud scheme involving at-home, self-administered tests. Prosecutors claim that between January 2022 and May 2026, Potash, the founder and CEO of Gaithersburg-based Tiero, LLC, conspired with others to submit more than $100 million in fraudulent claims to government programs and private insurers, including Medicare, Medicaid, and the Federal Employees Health Benefits Program.
The indictment alleges that the group used false emails, letters, and paperwork to deceive the Maryland Department of Health to obtain a Clinical Laboratory Improvement Amendments (CLIA) certification. They reportedly used this certification to falsely claim that medical providers were performing on-site testing at the company’s purported laboratory.
Through this scheme, prosecutors allege that over $50 million in insurance payments were generated for Tiero. The indictment also cites the use of criminal proceeds for vehicle purchases, $4 million in Maryland real estate, and several large security transfers. Potash faces charges of conspiracy to commit healthcare fraud, seven counts of healthcare fraud, and five counts of conducting transactions in criminally derived proceeds. He faces a maximum of 10 years in prison for each charged offense if convicted.
