Marcin Romanowski granted safe conduct certificate by Warsaw court

The Warsaw District Court has issued a safe conduct certificate (list żelazny) to Marcin Romanowski, a former Deputy Minister of Justice and PiS politician. Romanowski is a suspect in an investigation involving irregularities in the Justice Fund and has been residing abroad for nearly two years.

The ruling, delivered by Judge Konrad Mielcarek, allows Romanowski to return to Poland without the risk of immediate detention or arrest, provided he complies with court requirements. The court justified the decision by noting the ineffectiveness of previous measures, such as Interpol red notices and European arrest warrants, and argued that the legal provision requiring a prosecutor's consent for such certificates is unconstitutional as it violates the principle of equality of arms.

Minister of Justice and Prosecutor General Waldemar Żurek has strongly criticized the decision, labeling the judge a 'neo-judge' and accusing him of attempting to ensure immunity for a suspect. The prosecution has announced its intention to appeal the non-binding ruling. In response to the personal attacks from the Minister, Judge Mielcarek has announced plans to sue Żurek for the protection of his personal rights.
