Marco Rubio leads U.S. effort to dismantle the International Criminal Court

U.S. Secretary of State Marco Rubio is leading an effort to dismantle the International Criminal Court (ICC), describing the institution as a “standing world tribunal with near-unlimited reach” that threatens the sovereignty of nations. The U.S. administration has taken several steps to counter the court’s authority, including imposing sanctions on ICC President Tomoko Akane and senior trial lawyer Abdoulaye Seye, and exerting diplomatic pressure on allies to withdraw from the ICC.

These actions follow investigations into alleged U.S. war crimes and the ICC’s pursuit of an arrest warrant for Israeli Prime Minister Benjamin Netanyahu regarding actions in Gaza. The U.S. has also withdrawn from the United Nations Human Rights Council.

Alan Kessel, a former senior legal adviser to Global Affairs Canada and a negotiator for the Rome Statute, expressed concern over the court’s evolution. Kessel noted that while the ICC was designed as a “court of last resort” to address genocide and crimes against humanity when national judicial bodies fail, it has become a “very different animal” than the institution originally envisioned by its creators.
