Marcos Pontes proposes 8-year electoral ban for former STF ministers
Senator Marcos Pontes (PL-SP) has filed a complementary bill to prohibit ministers of the Supreme Federal Court (STF) from running in elections for eight years after leaving the court. The proposal, identified as PLP 268/2026, aims to amend the Ineligibility Law to include former STF members in the list of those barred from candidacy.
The restriction would apply regardless of the reason for departure, including voluntary or compulsory retirement, resignation, or loss of office. The bill includes a transitional provision that would affect former ministers who left the court recently, provided their eight-year period has not yet expired.
Pontes argues the measure is a preventive step to avoid conflicts of interest, noting that STF ministers judge cases involving parliamentarians and also serve on the Superior Electoral Court (TSE). The project stipulates that the rule would take effect upon publication but would not apply to elections held within one year of its enactment, adhering to the principle of electoral anteriority.
