Marta Esquivel proposes Fiscal Career Law for Public Ministry

Marta Eugenia Esquivel Rodríguez, a deputy from the Partido Pueblo Soberano (PPSO), has introduced a legislative proposal (file 25.777) to establish a formal Fiscal Career Law for the Public Ministry. The initiative aims to regulate the entry, permanence, evaluation, training, promotion, and transfer of prosecutors and support staff.

The bill proposes that permanent appointments and promotions be conducted through public merit-based contests administered by the Judicial Power’s Human Resources Management Directorate. Under this framework, the Attorney General would be required to appoint individuals based on their position in the registry of eligible candidates, limiting the ability to bypass these rules except in cases of legal incompatibility or grave objective facts.

To prevent the misuse of temporary appointments, the project seeks to limit interim positions and the use of 'inopia' appointments. It also establishes specific experience requirements, such as five years of service as an auxiliary prosecutor to qualify for a prosecutor role, and five years as a prosecutor to aspire to an assistant prosecutor position. The position of Attorney General would be excluded from this career track.
