Mayte Regina Gardea flags legal loophole in Mexico's gender identity law

Mayte Regina Gardea, former adviser to the Movimiento Ciudadano caucus in Chihuahua, said trans women have long fought for recognition of their identity rights. She warned that a group identifying as "trans lesbian women with male bodies" is exploiting a gap in Mexico’s gender identity law to evade obligations such as divorce settlements and child support, thereby violating the rights of women, families and children.

Gardea described the tactic as a “right‑wing narrative” that uses a legal vacuum to undermine trans rights and called for safeguards that would prevent identity changes when a pending family case exists. She announced plans to sue for usurpation and noted backing from more than 270 trans and non‑binary organisations nationwide.
