Medical debt affects millions of Americans as CFPB rule is vacated

Approximately 100 million adults in the United States are currently carrying medical debt. A recent report from the Urban Institute and Robert Wood Johnson Foundation indicates that 17.6% of adults aged 65 and older are burdened by medical debt, despite widespread Medicare coverage.

The Consumer Financial Protection Bureau (CFPB) previously finalized a rule intended to remove medical collections from the credit reports of roughly 15 million Americans. However, on July 15, 2025, a federal judge in Texas vacated this rule, ruling that the CFPB had overstepped its authority under the Fair Credit Reporting Act. Consequently, major credit bureaus including Equifax, Experian, and TransUnion have resumed reporting medical collections that exceed a $500 threshold.

Experts note several systemic issues contributing to medical debt, including coding disputes between hospitals and insurers, out-of-network providers working within in-network facilities, and personal liability created by guarantor signatures on admission forms. The Consumer Financial Protection Bureau estimates that nearly 4 million older Americans carry unpaid medical bills totaling approximately $53.8 billion.
