Mehmet Uçum discusses Law No. 7595 and constitutional reform

Mehmet Uçum, Presidential Advisor and Vice President of the Presidency's Legal Policy Board, has provided extensive commentary on Law No. 7595, the potential for a new constitution, and the binding nature of ECHR decisions.

Regarding Law No. 7595, Uçum clarified that the law is a specific and temporary measure aimed at the liquidation of terrorism and should not be used as a basis for general penal reform. He noted that terms like 'liquidation' in the text refer to practical processes rather than legal termination of an organization. He also assessed that the likelihood of the law being challenged via abstract norm review at the Constitutional Court is low, noting the October 17, 2026, deadline for such actions.

On constitutional matters, Uçum emphasized that any new constitution must be submitted to a public referendum, even if it receives more than 400 votes in Parliament. He suggested that a new constitution is unlikely to be completed during the current legislative term and will likely be handled by the 29th Term of the Grand National Assembly.

Addressing international law, Uçum argued that Article 90 of the Constitution cannot be used to mandate the implementation of European Court of Human Rights (ECHR) decisions. He stated that Article 90 pertains to conflicts between international treaty norms and domestic laws, whereas ECHR decisions are judicial rulings and do not hold the status of international treaty norms.
