Judicial rulings in Argentina and Chile address discrimination and labor rights

In Argentina, the Federal Court of Mendoza has ordered the Obra Social de Petroleros (OSPE) to immediately reinstate the health insurance coverage of Francesca Ortiz, a transgender woman. The insurer had unilaterally terminated her membership, claiming her gender affirmation process constituted an undeclared pre-existing condition. Judge Pablo Quirós ruled that gender identity cannot be categorized as a pathology or used as a basis for discrimination, ordering OSPE to maintain her original plan and rates while the legal injunction proceeds.

In Chile, the Supreme Court upheld a ruling regarding labor harassment at the Dr. Philippe Pinel Psychiatric Hospital in Putaendo. A nurse was awarded a maximum legal indemnity after the court confirmed fundamental rights violations. Due to delays in paying the initial sentence, the total amount owed by the institution, including fines and interest, has risen to over 24 million pesos.
