Meta faces scrutiny over AI data center tax strategy

Meta is utilizing an aggressive tax strategy by characterizing its artificial intelligence data centers as experimental projects. This classification allows the company to claim billions of dollars in federal tax credits intended for research and experimentation.

While CEO Mark Zuckerberg has described the company’s AI investments as a major success accelerating core business operations, internal disclosures suggest legal uncertainty. Meta’s own securities filings warn that these tax savings are vulnerable to being overturned by the Internal Revenue Service due to uncertainties regarding research tax credits. Some tax experts have described the strategy of labeling data center expansion as experimental as an aggressive interpretation of existing tax laws.
