Buenos Aires Supreme Court proposes AI use regulation for courts

The Supreme Court of Justice of the Province of Buenos Aires released a 45‑page draft regulation titled “Regulation for the Development and Responsible Use of Artificial Intelligence.” The proposal, now in public consultation until 7 August, seeks to create a Governance and Use of Artificial Intelligence Commission to oversee the integration of AI tools in the provincial judiciary.

The draft explicitly states that judicial decision‑making is indelegable and AI may not be used to decide cases, assess evidence, or draft legal reasoning. Judges and court staff must retain full responsibility for any AI‑generated output and must supervise its use. The court also barred the use of free or commercial chatbots such as ChatGPT for handling sensitive judicial information, citing data‑privacy risks. The initiative aims to improve procedural efficiency while safeguarding fundamental rights and the integrity of the justice system.
