Mexican Senate reviews criminalization of AI-generated intimate content

The Senate of the Republic has received a draft decree from the Chamber of Deputies aimed at criminalizing the non-consensual creation of intimate sexual content using artificial intelligence. The proposal seeks to reform articles 199 Octies and 199 Nonies of the Federal Penal Code to classify the generation, simulation, or editing of realistic images, videos, or audio of an intimate nature without consent as a violation of sexual privacy.

Under the proposed law, individuals found guilty of generating, distributing, or publishing such AI-generated materials could face prison sentences ranging from four to eight years, along with fines based on the Unit of Measure and Update (UMA).

The decree also includes specific provisions to penalize the creation of realistic or plausible sexual content involving children, adolescents, or individuals unable to consent, regardless of whether a real, identifiable victim exists.
