Mexican Senator proposes ending mobile phone cancellation penalties
Senator Aníbal Ostoa Ortega has introduced a legislative initiative to eliminate economic penalties for the early cancellation of mobile telecommunications services, specifically in cases involving financed devices. Under the proposal, companies would only be permitted to claim the proportional remaining balance of the device.
The initiative seeks to reform the Telecommunications and Broadcasting Law and the Federal Consumer Protection Law. It aims to prohibit companies from conditioning service contracts, continuations, or renewals on the payment of bonds, security deposits, or other prior financial guarantees.
Ostoa Ortega stated that the reform is intended to strengthen user rights, eliminate disproportionate contractual practices, and promote free choice and effective competition. The project is estimated to benefit approximately 24.8 million postpaid plan users in Mexico.
