Chaco Legislature to debate mandatory preventive detention law
The Chaco Legislature is set to debate the “Ley de Reiterancia Delictiva,” a proposed reform to the Criminal Procedure Code. The initiative, supported by Minister Carim Peche, aims to mandate preventive detention for individuals with multiple open criminal cases to prevent a “revolving door” effect where defendants return to crime while awaiting trial.
However, the project faces strong opposition from the Provincial Committee for the Prevention of Torture (CPPT). The committee argues the law is unconstitutional, violates the principle of innocence, and could exacerbate prison overcrowding. They noted that in provinces like Mendoza and Tucumán, where similar laws are active, recidivism rates among convicted individuals have actually increased.
