Mexican Supreme Court mandates pyrotechnic impact assessments for autistic children

The Supreme Court of Justice of the Nation (SCJN) has ruled that municipal governments in Veracruz must evaluate the potential health impacts of pyrotechnics on children and adolescents on the autism spectrum before authorizing their use.

In resolving amparo in revision 73/2026, the Court validated Article 10 of the Veracruz State Noise Law but established that authorities cannot grant permits based solely on compliance with legal timeframes. Municipalities are now required to analyze the type and quantity of fireworks, noise intensity, location, and scheduled times. If sufficient measures to prevent harm to individuals with autism cannot be identified, permits must be denied.

The ruling follows a legal challenge by a mother seeking to protect her daughter from the effects of loud noises. While the Court did not issue a general ban on pyrotechnics in the state, it emphasized that authorities have a reinforced responsibility to protect the rights and health of minors with disabilities.
