Mexican Tribunal requests Supreme Court intervention in forced displacement case
A Collegiate Tribunal in Mexico has requested that the Supreme Court of Justice of the Nation (SCJN) exercise its power of attraction regarding an amparo lawsuit filed by victims of forced displacement in Chihuahua. The lawsuit targets the Senate of the Republic for legislative omission, specifically for failing to enact the General Law to Prevent, Attend, and Comprehensively Repair Internal Forced Displacement.
The plaintiffs, representing families from the El Manzano and Monterde communities in the Sierra Tarahumara, argue that the legislative process was halted and internal regulations regarding deadlines were violated. While a District Court previously dismissed the case to avoid infringing on the separation of powers, the Collegiate Tribunal has requested SCJN involvement due to the legal significance of the issue and the existence of similar legal challenges.
