Mexico City Supreme Court clarifies birth certificate role in surrogacy cases

The Supreme Court of Justice of the Nation (SCJN) has validated a provision of the Mexico City Civil Code regarding birth certificates, clarifying that such documents do not automatically establish legal maternity in cases of surrogacy.

The ruling follows a legal challenge by a woman who participated in a surrogacy contract. She sought to ensure that her name appearing on a birth certificate as the person who gave birth would not legally obligate her to assume parental responsibilities or rights, as she provided no genetic material and intended only to provide gestational capacity.

The Court determined that while a birth certificate serves as initial evidence of maternity in ordinary cases, it creates a rebuttable presumption rather than a definitive legal attribution. In surrogacy arrangements, the Court noted that the certificate does not prove the identity of the mother. Instead, the determination of legal parenthood must be decided by judicial authorities on a case-by-case basis, considering the specific circumstances of each situation.
