Mexico Deputy Núñez Aguilar Pushes Faster Car Insurance Claim Rules
Deputy Ernesto Núñez Aguilar (PVEM) introduced a legislative reform to tighten Mexico’s car‑insurance settlement process. The proposal requires insurers to resolve a claim and pay any indemnity within 30 days of receiving complete documentation, and for automobile policies the final settlement must not exceed 60 days from the accident report. If the insurer cannot complete repairs within 60 days, it must provide the policyholder with a comparable replacement vehicle or a daily cash allowance for transport. Delays beyond the deadlines would trigger statutory interest penalties under article 276 of the Insurance and Bonding Institutions Law. The bill also mandates insurers to list the maximum repair period on the policy and to issue a technical valuation within 72 hours of a claim.
The measure aims to protect motorists’ mobility and reduce prolonged disputes over insurance payouts.
