IMSS modifies Modalidad 40 pension scheme to combat fraud
The Mexican Social Security Institute (IMSS) has implemented new regulations for Modalidad 40, a voluntary contribution scheme that allows workers to increase their pension amounts. President Claudia Sheinbaum clarified that the scheme is not being canceled, but rather adjusted to prevent fraud and the misuse of public resources. The administration noted that irregular practices involving law firms and other institutions have resulted in losses estimated in the hundreds of billions of pesos.
Under the new rules, new applicants must base their contributions on their last registered salary, with the possibility of increasing that base by up to one Unidad de Medida y Actualización (UMA). The general contribution limit remains at 25 UMAs. These changes are not retroactive; individuals already enrolled in the scheme or currently receiving pensions will maintain their existing conditions and contracted periods.
The Mexican Senate is reviewing the measures to determine if the changes require legislative action by Congress to ensure greater legitimacy. Meanwhile, business organizations such as CONCAMIN and CONCANACO have expressed support for the actions aimed at strengthening the legality and transparency of the pension system.
