Mexico Supreme Court denies eviction protection for 83-year-old man
The Supreme Court of Justice of the Nation (SCJN) in Mexico has upheld a ruling ordering the eviction of an 83-year-old man from his apartment in the Iztapalapa borough of Mexico City. The man, identified as Raul, lost a lease dispute after failing to pay 54 months of rent for a property he has occupied since 2007.
A majority of six ministers approved a proposal by Minister Arístides Guerrero García to reject the review of the case, stating that the legal arguments presented did not meet the requirement of exceptional interest. The court determined that the previous ruling by a Collegiate Tribunal should remain firm.
However, Ministers Irving Espinosa Betanzo, María Estela Ríos González, and Yasmín Esquivel Mossa dissented, arguing that the case warranted a review to address constitutional issues. They emphasized the need for judicial authorities to apply a perspective of aging when resolving cases involving elderly individuals to prevent them from falling into homelessness.
